Welcome to LibroLang. These Terms of Use govern your use of the LibroLang website, iOS application, and Android application (collectively, the "App" or "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Acceptance of Terms
By creating an account, downloading our mobile applications, or using our web app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy.
2. Acceptable Use and Anti-Abuse
You agree not to use the Service in any way that causes, or may cause, damage to the Service or impairment of the availability or accessibility of LibroLang. Specifically, you agree NOT to:
- Reverse Engineer: Decompile, reverse engineer, or attempt to extract the source code or proprietary algorithms of the Web, iOS, or Android applications.
- Scrape or Mine Data: Use automated systems, bots, or scrapers to extract AI-generated stories, audio, or vocabulary databases from our platform.
- Commercial Exploitation: Resell, distribute, or commercially exploit the reading materials, flashcards, or AI tutor features without explicit permission.
- Fraud & Scams: Use the platform for any fraudulent or malicious activity.
3. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of LibroLang and its licensors.
AI-Generated Content: The custom graded readers, audio narrations, and AI tutor feedback generated during your use of the app are provided to you under a personal, non-exclusive, non-transferable license for educational purposes. You may not claim copyright ownership over the AI-generated stories created by the platform.
4. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms. You are responsible for safeguarding the password that you use to access the Service from any device.
5. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. LibroLang expressly disclaims all warranties of any kind, whether express or implied. We do not guarantee that the AI-generated content (including translations and grammar definitions) will always be 100% accurate, error-free, or uninterrupted.
6. Limitation of Liability
In no event shall LibroLang, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
7. Account Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Use (e.g., engaging in scraping, abuse, or fraudulent activities). There is no tolerance for objectionable content or abusive users.
8. Apple App Store Requirements
If you downloaded the App from the Apple App Store, the following terms apply:
- Acknowledgment: You acknowledge that these Terms are concluded between you and LibroLang only, and not with Apple. LibroLang, not Apple, is solely responsible for the App and its content.
- Scope of License: The license granted to you for the App is a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
- Maintenance and Support: LibroLang is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services.
- Warranty: LibroLang is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.
- Product Claims: You and LibroLang acknowledge that LibroLang, not Apple, is responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: product liability claims; any claim that the App fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Rights: You and LibroLang acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, LibroLang, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third Party Terms of Agreement: You must comply with applicable third-party terms of agreement when using the App.
- Third Party Beneficiary: You and LibroLang acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which LibroLang operates, without regard to its conflict of law provisions.
